New Nigeria People's Party (NNPP)is seeking the order of an Abeokuta High Court to disqualify All Progressive Congress (APC) and its 20chairmanship and 236 Councillorship candidates from participating in this Saturday councils'poll in Ogun State for alleged violation of the Electoral Act .
State Chairman of the party, Comrade Olaposi Oginni in the fresh application filed on Thursday before the court is also asking for order to restrain Ogun State Independent Electoral Commission OGSIEC from dealing with APC and its candidates for the purpose of the Local Government Elections
NNPP through its Abuja based lawyer, kalu Kalu Agu Esquire is asking the court to declared the nomination of both the Chairmanship and Councillorship candidates of APC as null and void on the ground their nomination allegedly violated the provisions of the Electoral Act and Constitution of Federal Republic of Nigeria as regards the conduct of primary election of political party
It will be recalled that the nomination of APC candidates for the councils'poll had generated so much controversy with Governor Dapo Abiodun threatening to expel any of the aspirants who engage in anti-party activities by attempting to challenge the outcome of the party primary in the court
Meanwhile People's Democratic Party PDP lost its last minute legal battle for inclusion of the party's candidates for this Saturday councils'poll in the state
Justice Ogunfowora ruling on the application on Thursday at an Abeokuta High Court as filed by the Dr.Sikirulah Ogundele dismissed the application on the ground that it was too late for the electoral agency to alter its arrangement to accommodate fresh candidates for the poll less than 48 hours to the conduct of the councils'poll
The court agreed with the OGSIEC lawyer,Abeeb Ajayi that the Federal High Court judgement which recognizes Ogundele as State Chairman of the party was Obtained after conclusion of the arrangements for the excercise
Reactiing to the verdict, Ogundele vowed to challenge the dismissal of the application at the Appeal Court, asking party's members to remain calm
OGSIEC had earlier issued the nomination forms to PDP candidates through factional Assistant State Secretary, Adeleke Shittu, a loyalist of Late Buruji Kashamu whose group is laying claim to the control of the party in the state
